What is a Lasting Power of Attorney?

A Lasting Power of Attorney (LPA)  is a legal document that you ("the Donor") sign to authorize someone you trust ("the Donee") to make decisions about your personal welfare and/or your property and affairs when you no longer have the mental capacity to do so. 

This document must be signed by you in the presence of a Certificate Issuer (a lawyer, a psychiatrist or an accredited medical practitioner), and then sent to the Office of the Public Guardian (OPG) for registration.

There are 3 stages in the LPA registration process:

1. Submit LPA Documents

The OPG will then verify your documents and accept your LPA for registration.

2. Mandatory Waiting Period

There is a 3-week mandatory waiting period, a requirement under the Mental Capacity Act.

3. Registration

If the OPG receives no valid objections to your LPA application within the mandatory waiting period, your LPA will be registered.

It takes 3 weeks from the time the OPG receives your LPA to the time of its registration.

This is provided the OPG does not receive any valid objections. It is thus advisable for you to make your LPA as soon as possible, for your family's sake, and your own.
